Please read these Terms carefully before using My Instant Translation. By submitting an order or using the Service you accept these Terms in full. A plain-language summary of key points is provided below; it is for convenience only and does not form part of the legally binding Terms.
- Translations are produced automatically by machine (unless you buy human review) and may contain errors.
- Scanned or image-only documents require OCR; layout is not preserved and accuracy may be reduced.
- Files are deleted automatically after 7 days and cannot be recovered.
- Our liability is limited as set out in section 18.
1. Introduction and acceptance of these terms
Welcome to My Instant Translation ("My Instant Translation", "we", "us" or "our"). We operate an online, account-free platform that provides automated machine translation of documents and website content, delivered as downloadable files. By submitting an order, uploading a document, making a payment, or otherwise using our services (the "Service"), you ("you", the "Customer" or the "user") agree to be bound by these Terms and Conditions in full.
If you do not agree with any part of these Terms, you must not use the Service. Using the Service on behalf of an organisation confirms that you are authorised to do so and that the organisation accepts these Terms. These Terms apply to every order and exclude any terms or conditions you put forward that are not expressly agreed in writing by us.
No employee, agent or representative of My Instant Translation has authority to vary these Terms except in writing signed by an authorised signatory.
2. Definitions
"Order" means a request you submit to translate one or more files into one or more target languages. "Order Code" is the unique reference we generate to identify your Order and to grant you access to your translated files. "Source File" is the document you upload for translation. "Deliverable" or "Translated File" is the output file we produce and make available for download. "Machine Translation" means translation produced automatically by a translation engine, without substantive human post-editing unless you purchase the optional human review add-on.
"OCR" means Optical Character Recognition, the technology used to extract text from images or scanned documents that do not contain a selectable text layer. "Scanned Document" is a file (typically a PDF) made up of images of pages rather than embedded, selectable text.
3. Description of the Service
The Service provides automated machine translation of supported file formats into the target languages available at the time of your order. We use third-party translation engines (including DeepL) and, where necessary for scanned documents, third-party optical character recognition services. We do not operate the underlying translation or OCR technology ourselves; we integrate and deliver the output of those engines.
Unless you expressly purchase the optional human review add-on, the translation delivered is raw machine translation output. Machine translation is generated by software and, however sophisticated, cannot match the nuance, cultural sensitivity or accuracy of a qualified professional human translator. We make no representation that any machine-translated output is accurate, complete, contextually appropriate or fit for any particular purpose.
The Service is account-free. Access to your Deliverable is granted through the combination of the Order Code we issue and the email address you provided. You are responsible for keeping your Order Code secure; anyone who has both your Order Code and your email address may be able to retrieve your translated files before they are deleted.
4. The order process, quotes and word counts
When you upload a Source File we analyse it to count words and, for character-based languages, characters, and to attempt to detect the source language. The quote we present is calculated from that count and the per-unit price of each target language you select. Quoted prices are estimates based on our automated analysis and are confirmed when you proceed.
Our automated analysis may not correctly interpret every document. Files that are images, scanned, corrupted, password-protected, or that contain embedded content in unusual formats may not be counted accurately. Where we detect that a file may be a scanned document, we will inform you before you proceed, but our detection is itself automated and may not catch every case.
5. Pricing, payment and minimum order value
Prices are quoted in pounds sterling (GBP) unless otherwise stated. A minimum order value applies to every order; where the calculated total is below this minimum, the minimum order value is charged instead. This is shown clearly in your price breakdown before you pay.
Payment is processed through our third-party payment provider, Stripe. We never receive or store your full card details. By making a payment you authorise the payment provider to charge the amount shown. A surcharge or multi-language discount may apply as displayed in your breakdown. Prices may change at any time; the price applicable to your Order is the one displayed at the time you confirm and pay.
6. Scanned documents, OCR and reduced layout fidelity
If your Source File is a scanned document (for example a PDF made of page images) it contains no selectable text layer. To translate it we must first apply Optical Character Recognition (OCR) to extract the text. We will inform you when OCR is required, including before you pay where our system detects it.
You acknowledge and accept that OCR is an imperfect technology. OCR may misread characters, misinterpret fonts, fail to recognise handwriting, omit stamps or annotations, struggle with low-quality or skewed scans, and produce errors that then carry through into the translation. Because the original layout is an image and not structured text, it cannot be reproduced in the translated output.
Accordingly, where OCR is applied, the Deliverable is provided as plain translated text (for example a text or document file containing the translated text organised by paragraph) and the original page layout, design, fonts, tables and images are not preserved. Layout fidelity is materially reduced for any file that requires OCR, regardless of the output format chosen. If your scanned document is of poor image quality, the accuracy of both the OCR and the translation may be significantly impaired, and in some cases the output may be unusable. You should not submit a scanned document where the result must be relied upon without a human checking it.
7. Translation quality and no guarantee of accuracy
We do not guarantee that any translation will be accurate, complete, stylistically appropriate, or free of errors. Machine translation can introduce errors, omissions, mistranslations, gender or register inaccuracies, and loss of meaning, particularly with idiomatic, technical, legal, medical or creative content. Named entities, numbers, dates, units and formatting may be altered or corrupted.
Translation between certain language pairs, or involving languages with limited training data, may be of lower quality. We do not warrant that the translation will preserve meaning, tone, intent or formatting. The Service is a tool to assist you, not a substitute for professional translation.
8. No certification and unsuitability for official, legal or safety-critical use
Translations produced by the Service are not certified, sworn or notarised translations and are not produced by a qualified human translator unless you purchase the optional human review add-on. The Deliverable must not be relied upon for any official, legal, regulatory, medical, clinical, safety-critical, financial or compliance purpose without review and approval by a qualified professional.
You are solely responsible for verifying the accuracy and suitability of any translation before relying on, publishing, filing, submitting or distributing it. We accept no liability for any consequence of relying on an unverified machine translation.
9. Your responsibilities and authority to submit content
You confirm that you own, or are lawfully authorised to submit, every Source File and all of its content, and that translating it does not breach any contract, confidentiality obligation, intellectual property right, privacy right or any law. You are responsible for ensuring that you have the right to have the content translated and to receive a translated copy.
You must provide accurate contact information and a valid email address. Order access, notifications and Deliverables are sent to or accessed via the details you provide. We are not liable for failures or delays caused by inaccurate information provided by you.
10. Prohibited content and acceptable use
You must not upload, or request translation of, any content that is unlawful, fraudulent, infringes the rights of any person, or that we would be prohibited from processing. This includes, without limitation: content that infringes copyright, trade mark or other intellectual property; defamatory, threatening, harassing or abusive material; content that is illegal, obscene, pornographic or that promotes violence or terrorism; personal data processed in breach of applicable data protection law; content that facilitates illegal activity; and any content you are prohibited from disclosing by law or contract.
We may refuse, suspend or cancel any Order, and delete associated files, without liability, where we have reason to believe content is prohibited or that processing it would create legal risk for us. You are solely responsible for the content you submit and you indemnify us against any claim arising from it.
11. Intellectual property
You retain all rights in your Source File. By submitting it you grant us a limited, non-exclusive licence to process, translate, copy and transmit it solely for the purpose of providing the Service and fulfilling your Order.
We retain all rights in the Service, our brand, our website and our methodology. The translation output is derived from your Source File; subject to the rights of the underlying translation engine providers, you may use the Deliverable in accordance with these Terms. We grant no rights in the third-party engines or OCR technology we use.
12. Confidentiality and how we handle your data
We treat the content of your Source Files as confidential. Access is restricted to the extent necessary to operate the Service and is processed using the third-party engines described in these Terms. However, no system is perfectly secure, and transmission of files over the internet cannot be guaranteed fully secure.
Because the Service is account-free, we do not hold password-protected accounts for customers. Access to your files is controlled by your Order Code and email address. You should not submit content whose compromise would cause serious harm, and you should take care to protect your Order Code.
13. File retention and automatic deletion
To protect confidentiality, Source Files and Translated Files are automatically and permanently deleted seven days after the Deliverable becomes available. We also delete files from Orders that are abandoned, expire or fail. Once deletion has occurred, files cannot be recovered under any circumstances.
You are responsible for downloading and securely storing your Deliverable within the seven-day window. We have no obligation to retain, reproduce or re-translate any file after deletion, and we accept no liability for loss arising from failure to download in time.
14. Order access
Access to your Order and Deliverable is provided through your Order Code and the email address supplied at the time of order. If you lose your Order Code, we may, at our discretion and subject to verification, assist you, but we are not obliged to and we are not liable for any inability to retrieve files where the Order Code or email is lost or mis-stated.
If you believe your Order Code has been compromised, contact us immediately. We cannot reverse access or downloads that have already occurred using valid Order details.
15. Refunds and redeliveries
Due to the automated and immediate nature of the Service, orders are generally non-refundable once processing has commenced. If a translation fails due to an error on our part and we cannot deliver any usable output, we may, at our discretion, offer a refund or a re-translation.
We do not provide refunds where you have submitted an unsuitable Source File (for example a corrupted, password-protected, illegible or scanned file of poor quality), where OCR limitations have been disclosed and accepted, or where the translation is accurate but you are dissatisfied with stylistic choices. Refunds, where offered, will be made to the original payment method.
16. Service availability and maintenance
We aim to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, third-party outages, network issues, or events outside our control. We may change, suspend or withdraw the Service, or any file format, language or feature, at any time without liability, other than as expressly set out in these Terms or required by law.
17. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we exclude all warranties, conditions and terms (whether express, implied, statutory or otherwise) relating to the Service, including any warranty of satisfactory quality, fitness for a particular purpose, accuracy, non-infringement or that the Service will be uninterrupted or error-free.
No advice or information we give amounts to a warranty. You assume the entire risk of using the Service and the Deliverable. We rely on third-party engines (including DeepL, Stripe and OCR providers) and make no warranty about their performance or output.
18. Limitation of liability
To the maximum extent permitted by law, we shall not be liable to you for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, business, contracts, goodwill, data, anticipated savings or similar loss, whether arising in contract, tort (including negligence), under statute or otherwise, in connection with the Service.
Our total aggregate liability arising out of or relating to the Service, however arising, shall not exceed the amount you paid to us for the Order giving rise to the claim, or, if greater, one hundred pounds (£100). Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited or excluded by law.
You acknowledge that machine translation and OCR are inherently imperfect, that you have been advised of their limitations, and that the price charged reflects an automated service. You accept that the exclusions and limitations in these Terms are reasonable given the nature of the Service.
19. Indemnification
You agree to indemnify, defend and hold harmless My Instant Translation and its officers, employees, agents and affiliates from and against any claim, demand, action, loss, damage, cost or expense (including reasonable legal fees) arising out of or in connection with: your use of the Service; content you submit; your breach of these Terms; your violation of any law or the rights of any person; or any claim that your Source File or its translation infringes the rights of any third party.
20. Force majeure
We are not liable for any failure or delay in performing our obligations where the failure or delay is caused by events outside our reasonable control, including acts of God, internet or telecommunications failures, failures of our third-party providers, cyber attacks, government action, strikes, epidemics or pandemics. Where such an event occurs we will take reasonable steps to minimise its impact.
21. Third-party services
The Service relies on third parties including translation engine providers (such as DeepL), OCR providers, payment processors (such as Stripe) and hosting providers. We are not responsible for their acts, omissions, availability or output. Their terms and conditions and privacy policies may apply to your use, and you are responsible for reviewing them where relevant. We may change providers at any time without notice.
22. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them or the Service are governed by the laws of England and Wales, regardless of where you are located. The courts of England and Wales have exclusive jurisdiction over any dispute, except that we may bring proceedings to enforce intellectual property rights in any jurisdiction. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and nothing in these Terms reduces the statutory rights you have in the country where you live that cannot be waived.
23. Complaints and dispute resolution
We aim to resolve problems quickly. If you have a complaint, please contact us using the details available on our website with your Order Code and a description of the issue. We will investigate and respond. If a dispute is not resolved, it may (where applicable) be considered under the European Commission Online Dispute Resolution platform before court proceedings.
24. Changes to these Terms
We may update these Terms at any time. The version applicable to your Order is the one in force when you place it. We will indicate the date of last update at the top of this page. Continued use of the Service after a change constitutes acceptance of the updated Terms, subject to any rights you may have as a consumer that cannot be waived.
25. Your consumer rights
If you are acting for purposes outside your trade, business, craft or profession, you have legal rights as a consumer under applicable law (including, in the United Kingdom, the Consumer Rights Act 2015) that cannot be excluded or limited by contract. Nothing in these Terms affects those rights. Where any term conflicts with a non-excludable consumer right, the consumer right prevails and the conflicting term is read down or severed to that extent.
26. Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be severed and the remaining provisions remain in full force and effect. No failure or delay by us in enforcing any right constitutes a waiver of that right.
27. Entire agreement and contact
These Terms, together with any terms displayed at the point of order, constitute the entire agreement between you and us in relation to the Service and supersede all previous agreements. If you have any question about these Terms, please contact us through the details provided on our website.
